£17k in compensation for woman whose injury was caused by pot hole in the road
Our client, Mrs S, was riding her bicycle alongside a friend when she struck a deep pothole in the road and was thrown to the ground. She fell on her face suffering a whiplash injury to the neck, concussion and dental trauma. She required emergency dental treatment and had her two upper front teeth extracted. She then had a temporary denture fitted with the medical expert recommending the costly solution of dental implants to fix the problem.
Another firm of solicitors were initially instructed to act on the Claimant's behalf. This firm issued court proceedings, however, they negligently missed the four month time limit in which to serve the paperwork. Their application to extend the deadline for service failed. However the defendants insurers had already admitted liability so the Claimant had lost her chance of gaining compensation due to the failure of the previous solicitors to serve the claim form in time.
Boyes Turner's Personal Injury team took over the case four years after the accident and proceeded to bring a claim against the previous firm of solicitors for professional negligence.
The firm of solicitors admitted liability and following negotiations, the personal injury claim finally settled for £17k in compensation.
