Our client was at a New Year’s Eve party in the defendant’s house. After midnight, fireworks were being set off in the vicinity. Our client bent down to stroke the defendant’s dog, a golden Rottweiler, because it was scared and as he did so the dog attacked him by biting him several times on the left forearm. One of the bites went through and down to the bone.

Our client’s wounds were sutured in hospital requiring 11 stitches. He has since made a good recovery apart from occasional discomfort in the forearm however he has been left with permanent scarring.
Initially liability was denied and the defendants argued that the claimant was under the influence of alcohol and that the accident was caused due to the fault of our client who has voluntarily accepted the risk thereof.
After several months liability was finally accepted by the defendants but contributory negligence alleged. The claim was finally settled at no cost to our client for £3.8k taking into account the contributory negligence.
